NoteVault, Inc. (“NoteVault”) has created this Privacy Statement (“Statement”) in order to demonstrate our commitment to customer privacy. Because we gather important information from our visitors and from customers using our Services (“Service(s)”), including confidential customer and financial data and information, we have established this Statement as a means to communicate our information gathering and dissemination practices.
Information Collection & Use

Collected Information

Customers using our Services cause private Customer Data to be hosted at the NoteVault Site. This hosted data may include business activity, financial, and user location information. Additionally, NoteVault collects Personally Identifiable Information from our users at various points on the Site.

Registration

In order to use certain areas of the Site, you must first complete a registration form. During registration, you are required to provide your email address. Optional contact information that we request on the registration form include company name, contact name, and telephone number. We encourage you to submit this optional information so we can provide you with a more personalized experience on the Site. We use this information to initially populate portions of your NoteVault profile, which is needed to use the Services on the Site.
Once you submit the registration form, we send a welcome email to the provided email address. This email contains a temporary password and a link to sign in to the requested Services.
NoteVault stores this information for the sole purpose of sending this welcome email and for tracking the success of our registration process.
Once you have registered, you are eligible to trial certain Services before subscribing. To trial certain Services before subscribing, we require that you provide additional information to your NoteVault profile. Required information includes company name, company email address, contact name, contact email address, and time zone. Optional profile information includes company address, company phone, company fax, company web site URL, contact phone, mobile carrier, and mobile number. We encourage you to submit this optional information so we can provide you with a more personalized experience on the Site. We use this information to complete your NoteVault profile, which is needed to use the Services on the Site.

Subscriptions

If you choose to subscribe to certain Services on the Site, we request certain Personally Identifiable Information from you on the order form. You must provide information such as credit card number, expiration date, card code, billing customer name, and billing address. Optional information requested includes order number, purchase order number, tax exempt status, customer ID number, company name, telephone number, and fax number. We use this information for billing purposes and to process your order. If we have trouble processing an order, we will use this information to contact you.

Invite Users

If you trial or subscribe to certain Services on the Site and wish to invite additional users to join through your trial or subscription account, we will ask you to provide the invitee’s email address. We will automatically send the invitee a one-time email inviting him or her to register for the Services on the Site. Optional contact information that we request on the invitation form include your invitee’s name, company name, and telephone number. We encourage you to submit this optional information so we can provide your invitee with a more personalized experience on the Site. We use this information to initially populate portions of your invitee’s NoteVault profile and to grant the invitee access to the Services on the Site to which they have been invited.
Once you submit the invitation form, we send an invitation email to the provided email address. This email contains a temporary password and a link to sign in to the requested Services.

Uses of Information

Out of respect for your privacy, NoteVault does not send marketing communications or other communications that are not required, as outlined in this Statement.
NoteVault will not review, share, distribute, print, or reference any personal information or data except as provided in this Statement, or as may be required by law. Individual records may at times be viewed or accessed only for the purpose of resolving a problem, support issue, or suspected violation of the NoteVault Terms of Use Agreement, or as may be required by law. Of course, customers are responsible for maintaining the confidentiality and security of any user registration and password information that they may possess.
Service-Related Announcements
NoteVault will send strictly service-related announcements on occasions when it is necessary to do so. For instance, if our Service is temporarily suspended for maintenance, we might send you an email. Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account. Please see the “Choice and Opt-out” section.
Customer Service
Based upon the Personally Identifiable Information you provide, we will communicate with you in response to your inquiries, to provide the Services you request, and to manage your account. We will most likely communicate with you by email. Generally, you may not opt-out of these communications, which are not promotional in nature. Testimonials

We may post customer testimonials or lists on our web site, digital and or printed material which may contain personally identifiable information such as the customer’s name, company name and logo. We do obtain the customer’s consent prior to posting a testimonial with their name along with a written testimonial. However, we do not obtain the customer’s consent prior to posting a simple list of company names and or logos as a former or current client.

Information Sharing and Disclosure, Personally Identifiable Information, Third Parties

We share Personally Identifiable Information with a third party for credit card payment processing services on the Site. Specifically, NoteVault uses Authorize.net. When you subscribe to our Services, we only will share your personal and financial information as necessary for Authorize.net to provide their credit card payment processing services to NoteVault.
Authorize.net will use your information only to facilitate and complete customer-initiated or authorized transactions and service requests; to comply with federal, state and local laws, including credit reporting laws and card association rules; or to combat fraud or identity theft. Authorize.net is prohibited from using your Personally Identifiable Information for any other purpose.

Log Files

NoteVault gathers certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring URL, operating system, date/time stamp, and domain names.

We use this information, which does not identify individual users, to analyze trends, to administer the Site, to track users’ movements around the Site and to gather demographic information about our user base as a whole. NoteVault does not link this automatically-collected data to Personally Identifiable Information. NoteVault does not share automatically-collected information with third parties.

Cookies

A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use cookies on this Site. We do not link the information we store in cookies to any Personally Identifiable Information you submit while on the Site. If you reject cookies, you may still use the Site, but your ability to use some areas of the Site may be limited.
We use both session ID cookies and persistent cookies. We use session cookies to make it easier for you to navigate the Site. A session ID cookie expires when you close you browser. Security
NoteVault utilizes some of the most advanced technology for Internet security available. When you access the Site, Secure Socket Layer (SSL) technology protects your information using both server authentication and data encryption, ensuring that your data is safe, secure, and available only to registered users that you have authorized and invited to view your data.
The Site has security measures in place to help protect against the loss, misuse, and alteration of the Data under our control. NoteVault, Inc. also implements an advanced security method based on dynamic data and encoded session identifications, and hosts the Site in a secure server environment that uses a firewall and other advanced technology to prevent interference or access from outside intruders.

Business Transitions

Changes to Privacy Policy and Privacy Statement

Enforcement

NoteVault regularly reviews its compliance with this Statement. If we receive a complaint, it is NoteVault’s policy to contact the complaining user regarding his or her concerns. Users should expect an initial response within 72 hours. If necessary, unresolved complaints will be forwarded to our General Counsel for appropriate action. We will cooperate with any necessary regulatory authorities, including local data protection authorities, to resolve any complaints regarding the transfer of personal data that cannot be resolved between NoteVault and an individual.
